Terms of Service

These Terms govern your access to and use of AcreLens — our REST API, dashboard, MCP server, webhooks, and related services. By creating an account or making a request, you agree to these Terms.
1. Acceptance of these Terms
By signing up for an AcreLens account, generating an API key, or sending a request to our API, you agree to be bound by these Terms of Service (the “Terms”) and our Privacy Policy. If you are using AcreLens on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and “you” in this document refers to that organization.
If you do not agree to these Terms, you may not use the Services.
2. The Services
AcreLens provides programmatic and dashboard-based access to land intelligence reports for US property addresses. A report synthesizes data from public sources (NREL, USGS, FEMA, Geocodio, county records, and others) using artificial intelligence to produce structured analyses across four modes: off-grid, rural residential, recreational, and investment.
Reports are informational only. They do not constitute legal, financial, real-estate, environmental, engineering, or professional advice of any kind. See our Disclaimer for the full explanation of what reports can and cannot be relied on for.
3. Account & eligibility
You must be at least 18 years old and legally able to enter contracts in your jurisdiction to create an account. You are responsible for the accuracy of the information you provide during sign-up and for keeping your account credentials secure.
AcreLens authenticates accounts via Clerk. You agree to Clerk’s terms as part of using the Services. Billing is processed by Stripe; you agree to Stripe’s terms for payment-related interactions.
4. API keys
API keys grant the holder ability to call the AcreLens API and incur charges against your account. You are responsible for:
- Keeping API keys confidential. Do not embed live keys in client-side code, public repositories, or shared environments.
- Rotating compromised keys promptly. Use the dashboard’s revoke function and create a replacement key.
- All charges incurred by requests bearing your keys, whether authorized by you or not, until the key is revoked.
AcreLens stores only a SHA-256 hash of each key; we cannot recover a lost key. If you lose a key, revoke it and create a new one.
5. Acceptable use
You agree not to:
- Use the Services to violate any law, regulation, or third-party right.
- Reverse engineer, decompile, or attempt to derive source code from the Services, except where such restriction is prohibited by law.
- Resell, sublicense, or otherwise redistribute access to the API without a written commercial agreement with AcreLens.
- Probe, scan, or test the vulnerability of any AcreLens system or attempt to bypass authentication, rate limits, or access controls.
- Use automated means to scrape, mirror, or replicate the AcreLens API in bulk for the purpose of building a competing data product.
- Submit requests containing material that is unlawful, harassing, defamatory, or that infringes intellectual property rights.
- Use the Services in connection with consumer-credit, employment, insurance underwriting, or other regulated decisions where the Fair Credit Reporting Act or similar laws apply, unless you have a separate written agreement with AcreLens for such use.
6. Pricing & billing
AcreLens operates on a pay-as-you-go (PAYG) model. The current per-report rate is published on our Pricing page and reflected in your dashboard. Charges are deducted from your prepaid balance each time the API successfully completes a report.
We do not charge for failed reports, requests rejected with a 4xx validation error, requests served from cache for the same idempotency key, or requests rejected for insufficient balance.
You may top up your balance manually or enable auto-recharge from the dashboard. You may also configure daily and monthly spend caps. We are not liable for charges incurred up to your configured caps.
7. Free trial
New accounts may receive a limited number of free reports as described on the Pricing page at the time of sign-up. Free reports are consumed before any prepaid balance is debited. Unused free reports do not expire but are non-transferable and have no cash value.
8. Refunds
Top-ups and balance amounts are generally non-refundable except where required by law. If you encounter repeated failures on valid input (e.g. a properly-formatted address that should geocode), contact support@acrelens.com with the affected report_id values and we will issue a credit at our discretion.
9. Service availability
AcreLens is provided on an as-available basis. We do not guarantee any specific uptime, response time, or availability for accounts on the standard PAYG tier. Customers on a separately-negotiated Enterprise agreement may have an explicit Service Level Agreement (SLA) — those terms govern in case of conflict with these Terms.
We may temporarily suspend or limit Service access for maintenance, security, or to address abuse. We will provide reasonable advance notice of planned maintenance where practical.
10. Your data
You retain all rights to the property addresses, metadata, and other inputs you submit to the API (your “Inputs”). You grant AcreLens a worldwide, royalty-free license to process your Inputs solely as necessary to provide the Services, including transmitting them to subprocessors enumerated in our Privacy Policy.
The structured reports we return (the “Outputs”) are derived from public data and AI synthesis. You may use Outputs for your own internal analysis, redistribute them within your organization, and incorporate them into products or services you build, subject to the acceptable-use restrictions in Section 5 and the source attribution requirement: where Outputs cite a third-party data source (NREL, USGS, FEMA, etc.), retain the attribution when redistributed.
11. AcreLens intellectual property
AcreLens, the AcreLens logo, and the AcreLens API design (including the structure of request and response bodies, mode taxonomy, and sub-score schema) are the property of AcreLens, Inc. These Terms do not grant you a license to AcreLens trademarks or to copy our API surface for the purpose of building a substitutable competing service.
12. Webhooks
If you configure a webhook URL, AcreLens will deliver report-completion events to that URL on a best-effort basis with the retry schedule documented in our webhook docs. We do not guarantee delivery and are not liable for missed events. You are responsible for verifying HMAC signatures on inbound webhook bodies and for the security of your webhook endpoint (e.g. not accepting webhooks at internal/private addresses).
13. Suspension & termination
We may suspend or terminate your access to the Services for material breach of these Terms (including non-payment, abuse, or violation of the acceptable-use policy), upon notice except where immediate suspension is necessary to prevent harm. You may close your account at any time by emailing support@acrelens.com.
On termination, your access to the API and dashboard will cease, outstanding free reports and prepaid balance are forfeited unless we agree otherwise in writing, and Sections 5, 10, 11, 14, 15, 16, 18, and 19 survive.
14. Disclaimer of warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, AND NON-INFRINGEMENT. ACRELENS DOES NOT WARRANT THAT REPORTS ARE ACCURATE, COMPLETE, OR FIT FOR ANY PARTICULAR DECISION. SEE THE DISCLAIMER FOR DETAILS ON WHAT REPORTS ARE AND ARE NOT.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL ACRELENS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUES, WHETHER ARISING IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ACRELENS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
ACRELENS’S AGGREGATE LIABILITY ARISING FROM OR RELATED TO THESE TERMS WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO ACRELENS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES; IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
16. Indemnification
You agree to defend, indemnify, and hold harmless AcreLens, its officers, directors, employees, and contractors from any claim, damage, loss, or expense (including reasonable attorneys’ fees) arising from (a) your use of the Services in breach of these Terms, (b) your Inputs, (c) your products or services that incorporate AcreLens Outputs, or (d) your violation of any law or third-party right.
17. Modifications
We may modify these Terms at any time. Material changes will be announced by email to your account’s primary email address and posted to this page with an updated “Last updated” date. Your continued use of the Services after the effective date of a modification constitutes acceptance of the modified Terms.
18. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. The parties consent to the exclusive jurisdiction of state and federal courts located in Delaware for any dispute not subject to arbitration under Section 19.
19. Dispute resolution
Any dispute arising under these Terms will first be addressed by good-faith negotiation between the parties. If unresolved within thirty (30) days, the dispute will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, in Delaware, before a single arbitrator. Each party will bear its own costs except as the arbitrator may otherwise allocate.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.
20. Miscellaneous
These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement between you and AcreLens regarding the Services and supersede any prior agreements. If any provision is held unenforceable, the remaining provisions remain in effect. AcreLens may assign these Terms in connection with a merger or sale of assets; you may not assign without our prior written consent. Failure to enforce any provision is not a waiver.
